By virtue of a WRIT OF SEIZURE AND SALE, to me directed, from the Honorable Sixth Judicial District Court for the Parish of Tensas, aforesaid, in the above entitled cause, I will proceed to sale, at public auction, at the principal front door of the Courthouse in the City of St. Joseph, in Tensas Parish, Louisiana, on WEDNESDAY, the 3RD day of JULY, 2024, between the hours prescribed by law, beginning at 10:00 a.m., the following described property seized as “EXHIBIT A” in the above suit:

MOVABLE COLLATERAL SEIZED BY THE TENSAS PARISH SHERIFF’S OFFICE
Specific Property. All irrigation equipment of every kind and nature, including but not limited center irrigation pivots, wheel lines, hand lines, pumps, pvc pipe, sprinklers, drip line and emitters, filters, gearheads, and motors, windmills, solar panels or water measurement meters and control structures and other watering and irrigation equipment, now owned or hereafter acquired by Borrower/Debtor and wheresoever located and situated, including but not limited to the foregoing described equipment now or hereafter installed on, affixed to, placed upon or used in connection with the real estate described on Exhibit A attached [to the Security Agreement], together with all replacements, renewals, substitutions and proceeds derived therefrom.
All Licenses, Permits and Certificates for Water Rights now owned or hereafter acquired by Borrower/Debtor, whether such water and water rights are riparian, Appropriative or otherwise and whether or not appurtenant to the real estate described on Exhibit A attached [to the Security Agreement], all ditch and ditch rights and any shares of stock, licenses, permits and contracts evidencing such water or ditch rights, and all wells, reservoirs, dams, embankments, surface waters, stock ponds or fixtures relating thereto, together with all replacements, substitutions, accessions thereto and proceeds derived therefrom.

Property being located in Tensas Parish, Louisiana in Township 11 North, Range 10 East:

That portion of Lots 18 to 25, inclusive, of the subdivision of the Sundown Plantation, said lots lying in Sections 11 and 14, particularly described as follows, to-wit:

That certain tract of land situated on the SUNDOWN PLANTATION known as Lot No. 17 of said Sundown Plantation, according to a survey and map of said plantation dividing it into lots which said map of said plantation is recorded in Deed Book “L”, page 528 of the records of Tensas Parish, Louisiana; the lower or southern line of said Lot 17 being 54 chains and the upper or northern line being 56 chains; said lot having a front of 9.60 chains and the rear of 9.50 chains; said lot containing 52 acres, more or less.
TRACT III:
Beginning at a point on the line between Sections 14 and 15, T11N-R10E. Said point being South 18.20 chains from the corner common to Sections 10, 11, 14 and 15, T11N-R10E, and being the southwest corner of Lot 18 of Sundown Plantation. Thence East 42.78 chains to gravel road; thence along gravel road N 41 degrees 00 minutes E, 1.99 chains; thence West 44.08 chains to the line between Sections 14 and 15, T11N-R10E; thence South 1.50 chains to the point of beginning. That portion of ground designated as Lot No. 1 of the Subdivision of the Minden Hall Plantation, situated in Tensas Parish, Louisiana, as appears by a plat and process verbal thereof made by E. E. Scott, Registered Civil Engineer, on September 30, 1941, and recorded on October 30, 1941 in Notarial Record DD, folio 266, of the records in the office of the Clerk of Court of Tensas Parish, Louisiana, said Lot No. 1 being fully and more particularly described on said plat and process verbal as follows, to-wit:

FURTHER EXCEPTING THEREFROM the following portion of said property conveyed by Terry G. Mize, et ux to Terry G. Mize, Jr., et ux, as shown by deed dated February 5, 1981, recorded February 5, 1981 in Notarial Book 42, page 232, Document No. 117937, records of Tensas Parish, Louisiana, more fully and particularly described as follows, to-wit:
Lot 1 (on the Survey attached to the aforesaid document): From the Quarter comer of the East line of Section 15, T 11 N, R 10 E, Tensas Parish, Louisiana, bear South along the East line of the said Section 15 for 2,555.00 feet to a point on the North R/W line of a parish blacktop highway; thence bear N 88° 45’ W along the North RW line of the said highway for 440.00 feet and a set 1/2 pipe marking the POINT OF BEGINNNG.
From the Point of Beginning bear North for 415.00 feet and set a l” pipe; thence bear N 88°45’ W for 210.00 feet and set a l” pipe; thence bear South for 415.00 feet and set a 1” pipe on the North R/W line of a parish blacktop highway; thence bear S 88° 45’ E along the North R/W line of the said highway for 210.00 feet back to the Point of Beginning and containing 2.00 acres, more or less.

Mize, Jr. and Lisa Duncan Mize to William P. An 11.62 acre tract situated in the Southeast Quarter of Section 15, T11N-R10E, Tensas Parish, Louisiana; and being more particularly described as follows:

Scott, Registered Civil Engineer on September 30, 1941, and recorded on October 30, 1941 in Notarial Record DD, folio 266, of the records in the office of the Clerk of Court of Tensas Parish, Louisiana, said Lot No. 2 being fully and more particularly described on said plat and process verbal as follows, to-wit:
Lot No. 2 Minden Hall Plantation is more particularly described as follows: Beginning at a point on the South boundary of Section 15, Township 11 North, Range 10 East, and 22.50 chains west of the Southeast comer of said Section, run thence West along said South boundary 19.33 chains, thence North 9.23 chains to a stake in a ditch, run thence North 71 degrees West along the center of said ditch 4.45 chains to a stake, thence run North 29.34 chains to a stake, thence run East 23.54 chains to a stake, thence run South 40.00 chains to the place of beginning, containing 90 acres, more or less, and lying and being in the Parish of Tensas, State of Louisiana.

EXCEPTING THEREFROM the following portion of said Lot No. 2 of the said Minden Hall Plantation conveyed by Terry G. Mize to Marion M. Valentine, et ux by deed dated December 22, 1972, recorded March 9, 1973 in Notarial Book 26, page 482, records of Tensas Parish, Louisiana, to-wit:
A portion of Lot No. 2 of the Subdivision of the Minden Hall Plantation, said Lot No. 2 being more fully shown on plat and process verbal thereof made by E. E. Scott, Registered Civil Engineer on September 30, 1941 and recorded on October 30, 1941 in Notarial Record DD, folio 266 of the records in the office of the Clerk of Court of Tensas Parish, Louisiana, said portion being more fully described as follows, to-wit: FROM the Southwest comer of said Lot No. 2 of the Subdivision of the Minden Hall Plantation, run thence in an Easterly direction along the South line of said Lot No. 2 a distance of 900 feet to the point of beginning of the tract herein described, run thence in a Northerly direction at right angles to the South line of Lot No. 2 a distance of 200 feet to a point; run thence in an Easterly direction on a line parallel with the South line of Lot No. 2 a distance of 200 feet to a point; run thence in a Southerly direction parallel to the West line of the tract herein described a distance of 200 feet to the South line of Lot No. 2; run thence in a Westerly direction along the South line of Lot No. 2 a distance of 200 feet to the Point of Beginning. Lot 2 (on the Survey attached to the aforesaid document): From the Quarter Corner on the East line of Section 15, T11N, R10E, Tensas Parish, Louisiana, bear South along the East line of the said Section 15 for 2,555.00 feet to a Point on the North R/W line of a parish blacktop highway; thence bear N 88°45’ W along the North R/W line of the said highway for 1,473.95 feet and set a 1” pipe marking the POINT OF BEGNNING. From the Point of Beginning bear North for 210.00 feet and set a 1” pipe; thence bear N 88° 35’ W for 210.00 feet and set a 1” pipe; thence bear South for 210.00 feet and set a l” pipe on the North R/W line of the above mentioned parish blacktop highway; thence bear S 88°35’ E along the North R/W line of the said highway for 210.00 feet back to the Point of Beginning and containing 1.00 acres, more or less.

Lot 3 (on the Survey attached to the aforesaid document): From the Quarter Comer on the East line of Section 15, T11N-R10E, Tensas Parish, Louisiana, bear South along the East line of the said Section 15 for 2,555.00 feet to a Point on the North R/W line of a parish blacktop highway; thence bear N 88°45’ W along the North R/W line of the said highway for 1,473.95 feet; thence bear N 88°35’ W along the North R/W line of the same said highway for 820.20 feet and set a l” pipe marking the POINT OF BEGINNNG. The above described tract contains 175 acres, more or less, and is situated in the SW 1/4 of Section 10 and the NW 1/4 of Section 15, T11N, R10E, and is shown on Plat No. S82-12-R-T.P.10-11-10, dated April 17, 1982, prepared by Carl D. Ingram, Registered Surveyor No. 2022, a copy of which is attached to and recorded with deed from Terry G. Mize, et ux to Terry G. Mize, Jr., et ux, dated April 22, 1982, recorded April 22, 1982 in Notarial Book 45, page 46, Document No. 122190, records of Tensas Parish, Louisiana.

FOR PUBLIC COMMENT ON PROPOSED SETTLEMENT AGREEMENT BETWEEN THE LOUISIANA DEPARTMENT OF ENVIRONMENTAL QUALITY AND PLAINS PIPELINE, L.P.
The Louisiana Department of Environmental Quality and Plains Pipeline, L.P. (Respondent), Agency Interest Numbers 102675, 32982, 102676, and 102646, have entered into a proposed settlement agreement, Settlement Tracking No. SA-AE-24-0004, concerning the State’s allegations of environmental violations by Respondent at its facility in Concordia Parish and Tensas Parish, Louisiana, which allegations are set forth in Notice of Potential Penalty, Enforcement Tracking No. AE-PP-16-00412, and other violations included in the settlement and which are not in the Notice of Potential Penalty.
The Department of Environmental Quality will accept comments on the proposed settlement for the next forty-five (45) days. The public is invited and encouraged to submit written comments to the Louisiana Department of Environmental Quality, Office of the Secretary, Legal Division, Post Office Box 4302, Baton Rouge, Louisiana 70821- 4302, Attention: Michael J. MUNICIPALITY OF SAINT JOSEPH
CHANGE IN CLASSIFICATION
WHEREAS, the Mayor and Board of Alderman of the Town of Saint Joseph have submitted a Resolution to the Governor requesting a change in classification of Saint Joseph from “Town” to “Village,” in accordance with R.S. 33:342;
WHEREAS, R.S. 33:341 describes three classes of municipal corporations: those with five thousand inhabitants or more are cities; those with less than five thousand, but more than one thousand inhabitants are towns; and those with one thousand or fewer inhabitants are villages;
WHEREAS, the Governor has investigated the facts, in accordance with R.S. 33:342, through the U.S. Census Bureau 2010 Census Data; and
WHEREAS, the results of the 2020 Decennial Census show Saint Jospeh has a population of 831, a decrease from the 2010 Decennial Census which showed Saint Joseph had a population of 1,176; and
WHEREAS, based on the population changed as reflected by the U.S. Census Bureau, Saint Joseph is properly declared a “village” rather than a “town.”
NOW THEREFORE, I, JEFF LANDRY, Governor of the State of Louisiana, by virtue of the authority vested by the Constitution and laws of the State of Louisiana, do hereby order and direct as follows:
Section I: The municipal classification of the Town of Saint Joseph is hereby reclassified from “Town” to “Village”, in accordance with R.S. 33:341 and R.S. 33:342.
